Welcome to Timepilot! These Terms of Service ("Terms") govern your use of the Timepilot desktop application and website at timepilot.io (collectively, the "Service"). By using Timepilot, you agree to these Terms.

Please read these Terms carefully. If you don't agree, please don't use the Service.

1. Acceptance of Terms

By creating an account, downloading our application, or using any part of the Service, you agree to be bound by these Terms and our Privacy Policy. If you're using Timepilot on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Eligibility

You must be at least 18 years old to use Timepilot. By using the Service, you represent that you meet this age requirement.

3. Beta Program

3.1 Current Status

Timepilot is currently in beta testing. This means:

  • The Service is provided free of charge during the beta period
  • Features are actively being developed and may change
  • The Service may contain bugs or experience downtime
  • We may add, modify, or remove features without notice
  • Data backup and reliability are not guaranteed (though we do our best!)

3.2 No Commitment

During the beta period:

  • There is no minimum commitment period
  • You can stop using the Service at any time
  • We may terminate or modify the beta program at any time
  • Beta access does not guarantee access to the paid version

3.3 Transition to Paid Service

When Timepilot launches as a paid service:

  • We will notify you at least 30 days before charging begins
  • Pricing will be communicated clearly before any charges
  • You can choose to subscribe or stop using the Service
  • Beta users may receive special pricing (but this is not guaranteed)

4. Account Registration

4.1 Account Creation

To use Timepilot, you must create an account with:

  • A valid email address
  • A secure password
  • Accurate information

4.2 Account Security

You are responsible for:

  • Maintaining the confidentiality of your password
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access

4.3 One Account Per User

You may only create one account. Creating multiple accounts to abuse the Service or circumvent limitations is prohibited.

5. Acceptable Use

5.1 Permitted Use

You may use Timepilot to:

  • Track your own time and productivity
  • Generate timesheets for your work
  • Analyze your time usage patterns
  • Use the Service for personal or business purposes

5.2 Prohibited Activities

You may NOT:

  • Use the Service for any illegal purpose
  • Attempt to hack, reverse engineer, or compromise the Service
  • Use automated scripts or bots to access the Service
  • Interfere with or disrupt the Service or servers
  • Access another user's account without permission
  • Upload malware, viruses, or malicious code
  • Resell, rent, or redistribute the Service without authorization
  • Use the Service to track others without their explicit consent
  • Scrape or copy content from the Service using automated means
  • Remove or modify any proprietary notices or labels

6. Intellectual Property

6.1 Our Rights

Timepilot and the Service, including all software, designs, text, graphics, and other content, are owned by us or our licensors. They are protected by copyright, trademark, and other intellectual property laws.

6.2 Your Rights

You retain all rights to your data (time tracking information, documents, etc.). By using the Service, you grant us a limited license to:

  • Store and process your data to provide the Service
  • Use AI/ML to generate timesheet suggestions
  • Analyze aggregated, anonymized usage data to improve the Service

6.3 Feedback

If you provide feedback, suggestions, or ideas about Timepilot, we may use them without any obligation to you.

7. Privacy and Data

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your data.

Key Points:
• We do NOT take screenshots
• We do NOT record keystrokes
• We do NOT sell your data
• You can request data deletion by contacting [email protected]

8. Service Availability

8.1 No Guarantees

During the beta period, we do not guarantee:

  • Uninterrupted access to the Service
  • Error-free operation
  • Data accuracy or completeness
  • Compatibility with all devices or systems

8.2 Maintenance

We may perform maintenance, updates, or modifications that temporarily interrupt the Service. We'll try to provide notice when possible.

8.3 Data Backup

While we back up data, we recommend you export important time tracking records regularly. We are not responsible for data loss during the beta period.

9. Termination

9.1 By You

You may stop using Timepilot at any time. To delete your account, contact us at [email protected] (automated deletion coming soon).

9.2 By Us

We may suspend or terminate your access if:

  • You violate these Terms
  • You engage in fraudulent or illegal activity
  • We discontinue the Service
  • We believe your account poses a security risk

9.3 Effect of Termination

Upon termination:

  • Your access to the Service will cease
  • We may delete your account and data after 30 days
  • You should export any data you wish to keep before termination

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

We disclaim all warranties, including but not limited to:

  • Merchantability and fitness for a particular purpose
  • Accuracy or reliability of time tracking
  • Compatibility with your systems or workflows
  • Uninterrupted or error-free operation
  • Security of data transmission

Some jurisdictions do not allow disclaimer of implied warranties, so some of these disclaimers may not apply to you.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TIMEPILOT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE.

This includes damages arising from:

  • Use or inability to use the Service
  • Data loss or corruption
  • Inaccurate time tracking or billing
  • Security breaches or unauthorized access
  • Errors, bugs, or service interruptions

Our total liability for any claim related to the Service is limited to $100 or the amount you paid us in the last 12 months (currently $0 during free beta), whichever is greater.

12. Indemnification

You agree to defend, indemnify, and hold harmless Timepilot and its operators from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another person or entity
  • Your use of time tracking data in a manner that violates laws or others' privacy

13. Changes to Terms

We may modify these Terms at any time. When we do:

  • We'll update the "Last Updated" date
  • We'll notify you via email for material changes
  • Continued use of the Service constitutes acceptance of the new Terms
  • If you don't agree, you should stop using the Service

14. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles. Any disputes will be resolved in the courts located in California.

15. Dispute Resolution

15.1 Informal Resolution

Before filing a claim, please contact us at [email protected] to try to resolve the issue informally. We're a small team and want to make things right!

15.2 Arbitration

If we can't resolve a dispute informally, you agree to resolve it through binding arbitration rather than in court, except for small claims court disputes.

15.3 Class Action Waiver

You agree to resolve disputes individually, not as part of a class action or representative proceeding.

16. General Terms

16.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Timepilot.

16.2 Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in effect.

16.3 Waiver

Our failure to enforce any right or provision in these Terms does not constitute a waiver of that right or provision.

16.4 Assignment

You may not transfer your rights under these Terms. We may assign our rights to any affiliate or successor.
